Acceptable Use Policy

This Acceptable Use Policy (“AUP”) supplements the Vitki Data Terms of Service and applies to all users of Vitki Data products, APIs, datasets, and Apify actors (collectively, the “Services”). By using the Services, you agree to comply with this AUP.
Violations of this AUP may result in suspension or termination of your account, forfeiture of prepaid fees, and/or legal action.
1. Intended Use
Vitki Data provides structured datasets and APIs for legitimate business, research, analytical, and personal purposes. Our products are designed for use cases including but not limited to:
- Real estate market analysis and investment research
- Labor market intelligence and workforce planning
- Construction and development trend analysis
- Academic and policy research
- Business intelligence and competitive analysis
- Application development using real estate, job, or permit data
2. Prohibited Uses
You may not use Vitki Data products or any Data obtained through the Services for any of the following purposes:
2.1. Fair Credit Reporting Act (FCRA) Purposes
Vitki Data is NOT a consumer reporting agency as defined by the FCRA (15 U.S.C. 1681 et seq.). Our Data is NOT a consumer report.
You may not use the Data, in whole or in part, as a factor in:
- Determining eligibility for credit or insurance.
- Employment screening or hiring decisions.
- Tenant screening or rental application decisions.
- Any other purpose governed by the FCRA.
If you need data for FCRA-regulated purposes, you must obtain it from a licensed consumer reporting agency.
2.2. Discrimination
You may not use the Data to discriminate against any individual or group on the basis of race, color, religion, national origin, sex, familial status, disability, age, sexual orientation, gender identity, veteran status, or any other characteristic protected by applicable law. This includes but is not limited to:
- Housing discrimination in violation of the Fair Housing Act (42 U.S.C. 3601 et seq.).
- Lending discrimination in violation of the Equal Credit Opportunity Act (15 U.S.C. 1691 et seq.).
- Employment discrimination in violation of Title VII of the Civil Rights Act.
- Redlining or excluding geographic areas from services based on the demographic composition of their residents.
2.3. Harassment, Stalking, and Surveillance
You may not use the Data to:
- Stalk, harass, threaten, or intimidate any individual.
- Monitor, track, or surveil individuals without their knowledge and consent.
- Compile personal dossiers on individuals for purposes unrelated to legitimate business use.
- Contact property owners, sellers, or other individuals in a manner that constitutes harassment under applicable law.
- Facilitate domestic abuse, intimate partner violence, or witness intimidation.
2.4. Redistribution and Resale
You may not:
- Resell, sublicense, or redistribute raw Data in bulk to third parties.
- Offer the Data through your own competing data service, API, or marketplace listing.
- Share, publish, or make available bulk datasets obtained through the Services.
- Share API Keys or account credentials with unauthorized parties.

2.5. Illegal Activity
You may not use the Data in connection with:
- Fraud, identity theft, or financial crimes.
- Money laundering or terrorist financing.
- Tax evasion schemes.
- Any activity that violates applicable federal, state, local, or international law.
2.6. Service Abuse
You may not:
- Exceed the rate limits documented for your plan tier, or attempt to circumvent rate limiting.
- Use multiple accounts to circumvent usage limits or pricing tiers.
- Submit automated requests designed to overload or degrade the Services.
- Probe, scan, or test the vulnerability of the Services or any related system or network.
- Access the Services through any means other than the documented API interfaces and Apify actors.
3. Seller and Owner Contact Data
Certain products may include contact information for property sellers, owners, or other individuals (e.g., FSBO seller name, phone, email). If you access this data:
3.1. You must comply with all applicable telemarketing, anti-spam, and communication laws, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and applicable state regulations.
3.2. You must honor opt-out and do-not-contact requests promptly.
3.3. You may not use contact data for purposes unrelated to the transaction context in which it was provided (e.g., do not use a property seller’s phone number for unrelated marketing).
3.4. You may not combine contact data with other data sources to build profiles for purposes described in Section 2.1, 2.2, or 2.3.
4. Data Accuracy and Responsible Use
4.1. Data provided through the Services is sourced from public records and third-party sources. It may contain errors, omissions, or outdated information.
4.2. You are responsible for independently verifying any Data before relying on it for significant decisions, including but not limited to investment decisions, property valuations, or business strategy.
4.3. You acknowledge that real estate, employment, and economic data changes rapidly and that any dataset represents a point-in-time snapshot, not a guarantee of current conditions.
5. Reporting Violations
If you become aware of any use of the Services that violates this AUP, please report it to:

We will investigate all credible reports and take appropriate action, which may include account suspension or termination, notification to law enforcement, or legal action.
6. Enforcement
6.1. We reserve the right to investigate any suspected violation of this AUP and to take any action we deem appropriate, including:
- Issuing warnings.
- Suspending or terminating your account.
- Reporting violations to law enforcement.
- Pursuing legal remedies.
6.2. We may, but are not obligated to, monitor use of the Services for AUP compliance. We are not responsible for the actions of our users.
6.3. Our decision to take or not take enforcement action against any particular violation does not waive our right to enforce this AUP against the same or other violations in the future.
7. Changes to This Policy
We may update this AUP at any time. Material changes will be communicated via email or website notice at least 30 days before taking effect. Your continued use of the Services after the effective date constitutes acceptance of the updated AUP.
